1. The platform

Online Gallery offers artists a portfolio page and, on paid plans, a personal website and additional tools. Visitors can discover artworks and contact artists directly. Online Gallery is a presentation platform: purchases of artworks are agreed and settled directly between buyer and artist. Online Gallery is not a party to that sale, charges no commission and offers no buyer protection for it.

2. Accounts

You must provide a valid e-mail address and keep access to it secure; signing in works with e-mail links. You are responsible for activity on your account. Accounts are personal and may not be transferred or used for someone else's work without permission.

3. Your content and copyright

You keep all rights to the works and texts you upload. You confirm that you own the copyright to everything you publish, or have permission from the rights holder. By publishing, you give Online Gallery a non-exclusive licence to display your content on the platform, on your artist website and in promotion of the platform (for example a featured section). You can withdraw content at any time by removing it.

4. Acceptable use

Not allowed: uploading work that is not yours, unlawful or infringing content, misleading buyers, spam, scraping the platform, attempting to breach security, or using contact forms for fraud. We may remove content or suspend accounts that break these rules; where reasonable we will warn you first.

5. Screening and your own vigilance

To keep the platform trustworthy we screen automatically, and by hand where needed. Uploaded images of artworks are analysed by an AI model for signs of AI-generated or copied work, and compared against images elsewhere on the internet; profile photos are checked the same way. Messages sent through the website — to artists and to us — are screened for authenticity and known scam patterns, and messages that fail this check are not delivered. Flagged content and accounts may be held back for review, removed, or refused.

No screening is perfect. By using the platform you accept that Online Gallery cannot guarantee the authenticity of a work, an artist or a buyer, and that you remain responsible for your own judgement. Always make contact with the other party first and agree the details of a sale directly, especially for expensive works; pay only through the artist's own payment link or another method you can verify; and contact us if anything seems off before money changes hands.

6. Buying artworks: prices and currencies

Artists set their prices in their own currency. When you browse in another currency, prices are converted at the daily exchange rate and shown as a normal amount in your currency. Depending on the artist's payment method you either pay that converted amount directly in your currency, or the artist's original amount with the conversion handled by your bank or card issuer — small differences with the shown amount can occur due to rate movements and bank fees. The sale itself, including delivery, editions and returns, is agreed directly between you and the artist.

7. Subscriptions and payment

The Free plan is free within its limits. Premium is a monthly or yearly subscription; prices are shown on the pricing page including any discounts. You can cancel at any time, effective at the end of the paid period. If payment fails and remains unpaid after a reminder, Premium features (including your website) can be deactivated.

8. Artist websites and domains

Websites created with the website tool remain available while your Premium subscription is active. Domain names registered through the platform are subject to the registry's conditions; renewal fees are communicated in advance. If a subscription ends you keep the right to transfer your own domain elsewhere.

9. Availability and liability

We aim for high availability but cannot guarantee uninterrupted service. Online Gallery is not liable for indirect damage, lost profit or damage resulting from transactions between buyers and artists. Our total liability is limited to the amount you paid us in the 12 months before the event. Nothing in these terms limits liability that cannot legally be limited.

10. Changes and applicable law

We may update these terms; substantial changes will be announced in advance. Dutch law applies. Disputes are submitted to the competent court in the Netherlands. Questions: info@onlinegallery.art.
